Emerald Ash Borer

With the discovery of the Emerald Ash Borer in the Village of Libertyville, Village staff recommended to the Village Board of Trustees that two Village ordinances be amended that will assist in the elimination of Emerald Ash Borer. On September 27, 2011, the Village Board approved two ordinances supporting this measure.

Ordinance 11-O-58: The Ordinance amends Chapter 15, Sections 15-26 to 15-33 of the Municipal Code Regulating Nuisances. The Section name was changed from “Dutch Elm Disease” to “Dead, Diseased or Nuisance Vegetation.” This Section previously covered only species and varieties of Elm trees infected with what’s commonly known as “Dutch Elm Disease.” This Section now covers all species and varieties of Ash trees infected with Emerald Ash Borer and Chestnut Trees infected with Chestnut Blight Fungus. These sections regulate the removal of infected trees, on private and public property.

Ordinance 11-O-59: This Ordinance amends Chapter 9, Section 9-77 of the Municipal Code Regulating Replacement Trees. The Ash tree was taken off of the “desirable” replacement tree list and added to the “undesirable” replacement tree list.
